The Ministry of Justice and Constitutional Affairs (MoJCA) of the Federal Government of Somalia is the principal institution responsible for justice, constitutional affairs, and legal governance. Its core mandate includes upholding the rule of law, developing justice policies, overseeing the justice sector, drafting legislation and agreements, coordinating international legal cooperation, and directly providing essential legal services. The Ministry also plays a central role in the constitutional review process, ensuring Somalia’s constitution reflects the aspirations and rights of its people.
Established in 1956 during the Somali-Italian interim administration, the Ministry aimed to create a sustainable democratic system governed by a clear and structured legal framework. Before the collapse of the Somali state in 1991, it functioned as the Ministry of Justice and Religious Affairs, shaping legal and judicial policies.
After years of instability, several attempts were made to restore the Ministry. In 2000, the Transitional National Government (TNG) initiated efforts to re-establish it, but with little success. However, with the formation of the Transitional Federal Government (TFG) in 2004, the Ministry was revived. Throughout the transitional period, its role and structure evolved, leading to the establishment of various departments and affiliated institutions.
On November 4, 2012, with the appointment of Somalia’s first Federal Government cabinet, the Ministry was renamed the Ministry of Justice, Religious, Constitutional, and Reconciliation Affairs (MoJRCR). In January 2014, a new cabinet restructured the Ministry, retaining the Justice and Constitution portfolios under the title Ministry of Justice and Constitutional Affairs (MoJCA).
In January 2015, the Ministry became an independent entity, focusing exclusively on justice and legal affairs, following political negotiations within the government.
With the appointment of the sixth cabinet on August 13, 2022, the Ministry reaffirmed its mandate as the Ministry of Justice and Constitutional Affairs (MoJCA), reinforcing its role in justice sector reform, legal governance, and constitutional review.
